Kuwait to Examine Pending Industrial Design Applications

KUWAIT CITY - The Kuwait Patent Office has begun to examine pending industrial design applications, with the exception of those filed 10 or more years ago, which will be considered expired. |

3. Patent |

| |
a "utility" or "functional" patent is an exclusive right to make, use, and sell a new and useful process, machine, manufacture, or other composition, or any new and useful improvement on it. Design patents are related to the appearance of a manufactured article, not its use or operation, also it is a grant from the government that gives an inventor exclusive rights to an invention. |

The Patent Office should search prior patents to determine whether a proposed patent conflicts with a previously issued or pending patent. A patent validity differs from a country to another but not for more than 20 years which cannot be renewed. |

Once a patent lapses, the invention enters the public domain; this means that anyone can make, use, or sell it without obtaining a license from the inventor. However, a person can combine or add to unpatented or lapsed works in such a way as to create a new, patented invention. |

Registration Requirements: |

1. A Power of Attorney legalized up to the Kuwaiti Consulate.
2. An extract of the entry of the applicant in the commercial register, or an official copy of the memorandum or articles of association, if the applicant is a company or a body corporate legalized up to the Kuwaiti Consulate.
3. The title of the invention.
4. A summary description of the invention.
5. The number and date of the corresponding foreign patent.
6. The name, address, nationality and occupation of the applicant and inventor.
7. Two copies of the specifications of the invention together with the Arabic translation.
8. Two sets of the formal drawings bearing Arabic reference numerals.
9. An assignment document from the inventor to the applicant legalized up to the Kuwaiti Consulate. |

1. A Power of Attorney executed by the assignee legalized up to the Kuwaiti Consulate.
2. A deed of assignment proving the assignment signed by both parties and legalized up to the Kuwaiti Consulate.
3. The original Kuwaiti certificate of registration of the trademark for endorsement purposes. |
