KUWAIT CITY - The Kuwait Patent Office has begun to examine pending industrial design applications, with the exception of those filed 10 or more years ago, which will be considered expired. |

1. Trademarks |

| |
A trademark is a distinctive symbol, word, letter, number, picture, or combination thereof of adopted and used by a merchant or manufacturer to identify his/her goods. |

The trademark laws are implemented to keep businesses from "cashing in" on the goodwill and reputation of a competitor's products or services. It helps to prevent or punish the fraudulent marketing of goods or services as being those of another, presumably more reputable business. Obviously, if unchecked, such unfair competition deceives the public and steals trade from honest businesspersons. |

2. Patterns (Designs) |

The Kuwaiti Patent Office has started the process of examining, publishing and granting of designs. All designs filed with the Kuwaiti Patent Office are practically in the application stage, although the relevant designs are currently protected for 10 years as of the date of filing. |

Until the Kuwaiti Patent Office changes the present practice, all filed design applications shall remain as documentary evidence of ownership and priority claim even in the absence of examination and issuance of certificates by the Patent Office. The usual actions of opposition, renewal, payment of annuities, working, and so forth (with the exception of the assignment of applications), are not currently applicable in Kuwait. |

3. Patent |

a "utility" or "functional" patent is an exclusive right to make, use, and sell a new and useful process, machine, manufacture, or other composition, or any new and useful improvement on it. Design patents are related to the appearance of a manufactured article, not its use or operation, also it is a grant from the government that gives an inventor exclusive rights to an invention. |

4. Domain name |

Domain name is part of an internet address; every domain name ends with a top level domain (TLD), which is the part of the right of the period that indicates the type of entity that operates the site. The second level domain (SLD) is the part of the name to the left of the period, which is chosen by the business entity or individual registering the domain name.
The competition among firms with similar names and products preceding the .com TLD caused numerous disputes over domain name rights, and in Kuwait It is not possible to register domain names in Kuwait in the name of foreign companies, Local presentation is a must. If the client has a local company, it can be the owner of the domain name. |

A copyright is the exclusive right to print, reproduce, sell, and exhibit written material, musical compositions, art works, photographs, movies and television programs, data systems, and other creations placed in a tangible, preserved medium of expression. This exclusive right also extends to the public distribution, display or performance of that copyrighted work and to the preparation of derivative works, or also it is the right of an author or originator of a literary or artistic work, or other production that falls within a specified category, to have the exclusive use of that work for a given period of time. |
